ACTIVITY PARTICIPANT
RELEASE AND WAIVER OF LIABILITY AND MEDIA RELEASE AGREEMENT

Each Participant 18 or over must sign this Agreement
Please read this carefully before signing.

1. The Revel Club, LLC (“TRC”) organizes or offers a variety of activities and events such as trips, meetups, and training sessions for both members and non-members (collectively, the “Activities”). These Activities may involve risks such as driving on rough terrain, exposure to extreme weather, and limited medical care. As a participant, I acknowledge that the Activities come with risks, both known and unknown, that could result in physical or emotional injury, death, or property damage. I understand and agree that by signing this Release and Waiver of Liability and Media Release Agreement (this “Agreement”), I am voluntarily and knowingly releasing the TRC Parties (defined below) for all risks associated with the Activities.

2. In consideration for my participation in the Activities, I hereby agree to indemnify, and discharge TRC, its agents, members, managers, officers, volunteers, employees, contractors, trainers, and others acting on its or their behalf (collectively, the “TRC Parties”) on behalf of myself, my spouse or domestic partner, my children, my parents, my successors, assigns, personal representative and estate from all liability for all such risks relating to or arising from my participation in or relating to the Activities, whether known or unknown, and whether or not such risks are inherent to the activities in the Activities. My participation in the Activities is purely voluntary, and after reasonable inquiry into the risks I have elected to participate and to accept such risks. I understand that it is my responsibility to continually assess the conditions and circumstances of the Activities and that I may decline to participate in any aspect of the Activities at any time if I do not feel comfortable. I agree to abide by all TRC policies and procedures and the directions of the TRC Parties, including without limitation, acting responsibly at all times and refraining from the use of outside alcohol not provided by TRC (no alcohol consumption permitted for those under age 21) or any illegal drugs whatsoever (including marijuana) while participating in the Activities.

3. I hereby voluntarily release, forever discharge, promise not to sue, and agree to indemnify and hold harmless the TRC Parties from any and all liability, loss, costs, claims, or actions for illness, injury (including emotional distress), death, expenses, or damage to person or property (including my vehicle), which are in any way connected with my participation in the Activities or my use of TRC equipment or facilities (“Claims”), including without limitation any Claims alleging negligent acts or omissions, or violations of applicable law, by any TRC Parties.

4. I agree that any legal action arising under this Agreement or in connection with the Activities shall be brought only in the courts of Boulder, Colorado, and I hereby submit to exclusive jurisdiction and venue in such courts. I further agree that the substantive law of Colorado shall apply in such action without regard to conflict of law rules. In the event that any TRC Party incurs attorneys’ fees or other legal costs to enforce this Agreement, I agree to reimburse, indemnify, and hold harmless the TRC Parties against all such fees and costs. I agree that if any provision of this Agreement is found to be void or unenforceable, such provision shall be deemed revised to the minimum extent necessary to remain enforceable and the remaining provisions shall remain in full force and effect.

5. I hereby grant TRC the right to photograph, film and otherwise record my participation in the Activities and to use, reproduce, post, tweet, assign, distribute and otherwise utilize in any manner photographs and recordings of myself arising from my participation in the Activities (which may include photographs recordings of my vehicle and its license plates), without any further credit or compensation to me and with no further rights of approval. I agree that any such photographs and recordings shall be sole property of TRC upon creation and I hereby release TRC from liability for any violation of any personal, privacy and/or proprietary rights I may have in connection with the use of any such photographs and recordings (including without limitation so-called “moral rights”).

BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT I HAVE ASSUMED ALL RISK OF PARTICIPATION IN THE ACTIVITIES AND HAVE RELEASED AND WAIVED ANY RIGHT TO MAINTAIN A LAWSUIT OR OTHER LEGAL ACTION AGAINST THE TRC PARTIES ON THE BASIS OF ANY CLAIM ARISING FROM MY PARTICIPATION IN SUCH ACTIVITIES. I HAVE FURTHER CONSENTED TO RECORDINGS AND PHOTOGRAPHS OF ME DURING THE ACTIVITIES.

I have had sufficient opportunity to read this entire Agreement and to ask questions regarding any aspect of this Agreement. I have read and fully understood this Agreement, and I agree to be bound by its terms.

PARENT’S OR GUARDIAN'S WAIVER OF CLAIM(S) OF MINOR

If Participant is under age 18 or otherwise unable to consent: In consideration of the Minor(s) named below being permitted to participate in the TRC activities described above, I agree that they are bound by this Agreement, and that the Release contained herein is voluntary and informed pursuant to Colorado Revised Statute 13-22-107, and is valid. I further agree to indemnify and hold harmless TRC from all Claims which are brought by, or on behalf of Minor(s), and which are in any way connected with such participation by Minor(s). I agree to pay reasonable attorneys’ fees and costs incurred by TRC Releasees to enforce this Release.
